Platform operator

The Ocean platform is operated by GrowVolution e.V. The association provides and maintains the marketplace infrastructure that lets maintainers publish modules and lets users discover and license them.

Use of the platform

Using the platform itself is free of charge. Browsing, searching and creating an account do not require the payment of any fees to the platform operator. Costs only arise from purchasing paid modules, which are billed by the respective maintainer.

Contractual partner and Merchant of Record

For every purchase, the contractual partner is the respective maintainer or vendor of the module, who acts as Merchant of Record. GrowVolution e.V. is merely the operator of the platform and does not become a party to the purchase contract. The terms, invoicing and any warranty for a module are provided by that maintainer.

Prices

All prices shown on the platform are net prices. The platform is primarily aimed at business customers. The applicable gross price, including any taxes, is shown during checkout before the purchase is completed.

Availability

The platform operator endeavours to keep the platform available, but does not guarantee uninterrupted or error-free operation. Access may be temporarily restricted, for example due to maintenance, technical faults or circumstances beyond the operator's control.

Changes to the platform

The platform operator may further develop, change or discontinue features of the platform. These terms may be adjusted where necessary, for example to reflect changes to the platform or to legal requirements. The current version is published on this page.

Acceptable use

Users may not misuse the platform. In particular, it may not be used to distribute unlawful content, to interfere with its technical operation, to circumvent access controls or to gain unauthorised access to systems or data. The platform operator may restrict or suspend access in the event of misuse.

Accounts

Some functions require a user account. Users are responsible for keeping their access credentials confidential and for the activities carried out through their account. Accounts must not be shared with unauthorised third parties.

Intellectual property

The modules offered on the platform remain subject to the rights of their respective authors and are governed by the licenses under which they are distributed. Trademarks, names and content of the platform remain with their respective owners. Details on the licensing of the platform's own components are provided on the Licensing page.

Liability

The platform operator is not liable for software distributed through the platform. Such software is provided by the respective maintainers and is used at the user's own risk. Otherwise, the platform operator is liable only in accordance with the applicable statutory provisions; mandatory statutory liability, in particular for injury to life, body or health and under the Product Liability Act, remains unaffected.

Support

Support requests concerning a purchased module must be directed to the respective maintainer, who is your contractual partner for that module. The platform operator does not provide support for third-party modules.

Consumer rights and right of withdrawal

Where a user purchases as a consumer, statutory rights such as the right of withdrawal arise from the contract with the respective maintainer as Merchant of Record. For paid digital content that is delivered immediately, the right of withdrawal can lapse once delivery has begun — that is, when the first download is started — as expressly confirmed at that point.

Governing law

The law of the Federal Republic of Germany applies. If the user is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for disputes arising from the use of the platform is the registered seat of GrowVolution e.V. Mandatory consumer-protection provisions of the state in which the user has their habitual residence remain unaffected.
